Agreement to purchase and use Machinery Sliders:
Neither party shall be liable to the other for any indirect, consequential, incidental, or punitive damages arising out of or related to this Agreement. Under no circumstances will the Seller be liable for special, incidental or consequential damages, whether such damages are sought in contract, in tort (including but not limited to negligence and strict liability) or otherwise, and the Seller shall in no event exceed the purchase price of the Products on which such liability is based.

Any disputes arising from or relating to this Agreement shall be resolved by arbitration in the State of Pennsylvania in Schuylkill County, unless otherwise agreed by the parties in writing. Each party shall bear its own costs and expenses in connection with any such arbitration.
